Molly Taylor wins appeal

I am advised that Molly has won her appeal against exclusion from the F2 results in the Tas Tarmac Rally recently. I have no detail of the appeal hearing yet.

It not the first nor will it be the last time. If the rules are so clear cut, why is simple stuff like this up for interperation ?

If i had interperated the rules that way i would have done the same thing.

The longer im involved in this sport the more it leaves a bad taste in my mouth. Cams really need to sort this crap out.

At least now its on like Donky Kong for Coffs

For the uninitiated

The ARC sporting regs include an F16 component (these are not Tech regs, they are within the sporting regs, not that that makes much difference), it says you can use 15 inch wheels and up to 12 tyres at an event.

The supp regs for the event in question included an article that said you could use 18 inch wheels, except if you were S2000 or Group N(P) but you were limited to 10 tyres.

Not unreasonably Molly's team though that given she wasn't driving a s2000 or group NP then she was permitted by the CAMS approved supp regs to use 18 inch wheels and limited to 10 tyres.

Presented it like that at scrutineering after email exchanges with CAMS Manager Rally/OFf road.

Matter was drawn to attention of tech Commissioner by another competitor - the tech commissioner decided that supp regs didn't overrule sporting regs and convinced stewards of the same view. Result - Molly excluded from F16 for event.

There were many in the rally community who have acted under the belief that supp regs should be obeyed. Apparently the appeal tribunal agreed. - There were other grounds of appeal as well. Unfortunately I think the tech commissioner demonstrated a poor understanding of the situation. Indeed my view is that he should have advised the other competitor to lodge a protest if they thought they were being dudded.

The other important thing was that there was clearly no attempt to cheat, there was discussion with CAMS - the vehicle was presented to scrutineering with the wheels etc, its not like they just appeared on the car at different times.

I am keen to get details of the appeal hearing to understand which ground/s was/were accepted - but I think we can all go back to reading the supp regs and ensuring we follow them.

Jast to add to Factors post the first vehicle eligibility rule in the supp regs states.

For the ARC vehicle eligibility will be in accordance with Section 11 in the CAMS 2008 Manual of Motor Sport- National
Rally Code, 2008 Australian Rally Championship Regulations - Part 1 Sporting Regulations and Part 2 –Technical Regulations

I have stayed quiet on the matter pending the hearing results,

but for the record, strangly enough considering we were the ony other competator in the class, Mathew or I at no stage during Saturday or Sunday said anything to the Tech Commissioner on the matter, I queried the rule At scrutineering on thursday and was told rules as per supp regs, end of story !!!

The first we had found out she had been excluded was on Sunday regroup, when Molly told us.

Yes i am in agreance here, If i thought it was warrented, it should have been me making the protest considering it affected us, and was probably going to.

But i am also keen to get details of the hearing.

Ben When your passing this way then on the way to Coffs you want to stop and borrow anything off my sprinter just in case? If you could afford the fuel I'd lend you a tow car and you could borrow the whole car and trailer just as long as its running again for the RdeF. nothing like a spare car for parts, then you could really give it everthing. motor running a bit rough but

I understand that the appeal pretty much turned on the issue that F16 wasnt mentioned in the exclusions to the freedoms in the supp regs - therefore F16 wasnt included in the exclusions - therefore the freedoms were allowed for F16 - all very simple and as most of us thought at the time.

I understand that Mark Taylor found the appeal process to be very proffessional and very open and positive.
